These Terms & Conditions ("Terms") govern your access to and use of Core3 ("we", "us", "our"), including our website at coreiii.com and our mobile applications (the "Service"). They form a binding agreement between you and Core3.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.
Core3 is currently in a pre-launch / beta phase. Features may change, be incomplete or be withdrawn, and the Service may contain errors. Do not rely on it as your sole source of training, nutrition or health guidance.
1. Eligibility and accounts
- You must be at least 18 years old (or the age of majority where you live) to use the Service.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You are responsible for all activity that occurs under your account. Tell us promptly at info@coreiii.com if you suspect unauthorised use.
2. The Service
Core3 provides AI-assisted training plans, structured workouts, nutrition targets and recovery insights, and can connect to third-party platforms (Garmin, Wahoo, Hammerhead, Zwift and Ōura) to sync your activity and health data. We may add, change or remove features at any time.
3. Health, fitness and medical disclaimer
The Service is not a medical device and does not provide medical, dietary or professional advice. Always consult a qualified healthcare professional before starting, changing or stopping any exercise or nutrition programme.
- Training and nutrition guidance is general and informational, generated in part by automated and AI systems, and may not be appropriate for your individual circumstances.
- Physical exercise carries inherent risks. You participate voluntarily and assume responsibility for exercising within your limits and stopping if you feel unwell.
- If you experience pain, dizziness, chest discomfort or other symptoms, stop and seek medical attention. Call your local emergency services in an emergency.
- Metrics from the Service and connected devices are estimates and should not be relied on for medical decisions.
4. Acceptable use
You agree not to:
- Use the Service unlawfully, or in breach of these Terms or any third-party platform’s terms.
- Access another user’s account, or attempt to disrupt, reverse-engineer, scrape or gain unauthorised access to the Service or its systems.
- Upload malicious code, infringing content, or content that is unlawful, harmful or misleading.
- Resell, sublicense or commercially exploit the Service without our written permission.
5. Connected third-party services
When you connect a third-party platform, you authorise us to access and process data from that platform on your behalf. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for them. You can disconnect a provider at any time, which stops further syncing.
6. Intellectual property
The Service, including its software, design, branding and content (other than your own data), is owned by Core3 or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.
7. Your data and content
You retain ownership of the data and content you provide. You grant us a licence to host, process and use it to operate and improve the Service and to provide it back to you, as described in the Privacy Policy. You are responsible for ensuring you have the right to share any data you connect or upload.
8. Fees and subscriptions
During the current beta, the Service is provided free of charge. We may introduce paid plans or subscriptions in future; if we do, we will publish the applicable pricing and terms and obtain any consent required before charging you. Any paid features purchased through an app store are also subject to that store’s terms.
9. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue the Service or any feature, in whole or in part, at any time. We may also update these Terms; we will post the updated version with a new date and, where changes are material, take reasonable steps to notify you.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 ("CPA") or other laws that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, and subject to your rights under the CPA, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for gross negligence or for death or personal injury caused by our negligence.
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable costs arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right, to the extent permitted by law.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, liability and governing law) will continue to apply.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Subject to your rights under the CPA, you agree to the jurisdiction of the High Court of South Africa, Western Cape Division, for any dispute. We encourage you to contact us first at info@coreiii.com so we can try to resolve any issue informally.
15. General
- These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service.
- If any provision is found unenforceable, the remaining provisions continue in effect.
- Our failure to enforce a right is not a waiver of it.
- You may not assign these Terms without our consent; we may assign them in connection with a reorganisation, merger or sale.
