Introduction

These Terms of Service (“Terms”) govern your access to and use of the Core3 platform, including our website, applications, and related services (collectively, the “Service”), operated by Core3 (“we,” “our,” or “us”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using Core3, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account credentials secure and confidential.
  • Notify us promptly if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Description of Service

Core3 is an adaptive AI performance coaching platform for athletes. The Service may include, but is not limited to:

  • AI-powered coaching insights and personalised training plans.
  • Activity tracking, analytics, and performance metrics.
  • Nutrition logging and dietary feedback.
  • Calendar and workout scheduling tools.
  • Integration with third-party services (e.g. Strava, Wahoo).
  • Daily wellness check-ins and recovery tracking.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service or its infrastructure.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Scrape, harvest, or collect data from the Service by automated means without our consent.
  • Use the Service to transmit malware, spam, or other harmful content.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Share your account credentials with others or allow others to access your account.

5. Third-Party Integrations

The Service allows you to connect third-party accounts and services, including Strava and Wahoo. When you connect a third-party service:

  • You authorise us to access and import data from that service as described in our Privacy Policy.
  • Your use of those third-party services is subject to their own terms and privacy policies.
  • We are not responsible for the availability, accuracy, or practices of third-party services.
  • You may disconnect third-party integrations at any time through your account settings.

Our use of the Strava API is subject to the Strava API Agreement. We display Strava data with proper attribution as required.

6. AI Coaching Disclaimer

The Service includes AI-powered coaching features that provide training suggestions, nutrition guidance, and wellness insights. You acknowledge and agree that:

  • AI coaching is provided for informational and educational purposes only and does not constitute medical, nutritional, or professional athletic advice.
  • You should consult qualified professionals (e.g. a physician, registered dietitian, or certified coach) before making significant changes to your training, diet, or health routines.
  • AI-generated recommendations may not be accurate, complete, or suitable for your individual circumstances.
  • We do not guarantee any specific outcomes, performance improvements, or health results from using the Service.
  • You use AI coaching features at your own risk and discretion.

7. Intellectual Property

The Service, including its design, features, code, content, trademarks, and logos, is owned by or licensed to Core3 and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any content you submit to the Service (e.g. check-in data, nutrition logs, coach messages). By submitting content, you grant us a limited, non-exclusive licence to use, process, and store that content as necessary to provide and improve the Service.

8. Fees and Payment

Core3 may offer free and paid tiers of the Service. If you subscribe to a paid plan, you agree to pay all applicable fees as described at the time of purchase. We may change pricing with reasonable notice. Fees are non-refundable except as required by law or as expressly stated in our refund policy. If payment fails, we may suspend or restrict access to paid features until the payment issue is resolved.

9. Termination

You may stop using the Service and request account deletion at any time by contacting us at info@coreiii.com.

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in conduct that harms other users or the Service, or for any other reason at our discretion with reasonable notice where practicable.

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy, including any data retention and deletion obligations.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or reliability of any content, data, or recommendations provided through the Service, including AI-generated coaching.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORE3 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Core3 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Service and updating the “Last updated” date. For material changes, we may also notify you by email or through the Service. Your continued use of Core3 after the effective date constitutes acceptance of the revised Terms.
